1. Agreement to these Terms
These Terms of Service (“Terms”) govern your access to and use of the Harley-Davidson Leadership Story website (the “Site”), operated by the Harley-Davidson Leadership Story Project (“we,” “us,” or “our”).
By accessing or using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.
2. About the Site
The Site is an educational expansion to the Harley-Davidson leadership story at the AMA Motorcycle Hall of Fame. Content is provided for informational and museum-related purposes. Harley-Davidson Motor Company and the American Motorcyclist Association / AMA Motorcycle Hall of Fame are separate organizations. References to those brands or institutions do not by themselves create a partnership, endorsement, or agency relationship beyond what is expressly stated.
3. Eligibility
You must be at least 13 years old to use the Site. If you submit a photo or other contribution, you represent that you are at least 18 years old (or the age of majority in your jurisdiction) and have authority to grant the rights described in these Terms and in the contribution form.
4. Acceptable use
You agree not to:
- Use the Site in any way that violates applicable law or these Terms;
- Attempt to gain unauthorized access to the Site, related systems, or data;
- Interfere with or disrupt the Site, including through malware, scraping that burdens the service, or denial-of-service activity;
- Upload unlawful, defamatory, harassing, infringing, or otherwise objectionable content;
- Misrepresent your identity or your relationship to any person depicted in a submission;
- Use Site content for commercial purposes without our prior written permission, except for fair use or other rights you may have under law.
5. Intellectual property
Unless otherwise noted, the Site’s text, design, graphics, logos, compilation, and other materials are owned by us or our licensors and are protected by intellectual property laws. Harley-Davidson, related marks, and museum marks are trademarks of their respective owners. You may view and share Site pages for personal, non-commercial, or press-related use that is consistent with the purpose of the exhibit, provided you do not remove notices or misrepresent the source of the materials.
6. Photo and content submissions
All photo submissions, captions, permissions, and related materials are processed by the AMA Motorcycle Hall of Fame on its own platform. This Site does not collect or process photo submissions. Any submission is governed by the AMA Motorcycle Hall of Fame’s submission terms, consent language, and privacy policy. Questions about submission rights, review, or display should be directed to the AMA Motorcycle Hall of Fame.
7. Third-party services and links
The Site may embed or link to third-party services (for example, video hosts). Your use of those services is governed by their terms. We do not control and are not responsible for third-party content or practices.
8. Disclaimers
THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT CONTENT WILL BE COMPLETE OR CURRENT.

9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR PARTNERS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR THESE TERMS, WHETHER BASED IN CONTRACT, TORT, OR ANY OTHER LEGAL THEORY. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100), OR THE AMOUNT YOU PAID US (IF ANY) TO USE THE SITE IN THE TWELVE MONTHS BEFORE THE CLAIM, WHICHEVER IS GREATER.
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.
10. Indemnification
You agree to defend, indemnify, and hold harmless the exhibit project and its partners, officers, and agents from and against claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your use of the Site, your submissions, or your violation of these Terms or applicable law.
11. Termination
We may suspend or terminate access to the Site, or remove content, at any time if we believe you have violated these Terms or if continued access would harm the Site, users, or partners. Provisions that by their nature should survive (including intellectual property, disclaimers, limitation of liability, and indemnification) will survive termination.
12. Changes
We may update these Terms from time to time. The “Last updated” date will change when we do. Continued use of the Site after changes become effective constitutes acceptance of the revised Terms.
13. Governing law
These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law rules, except where mandatory consumer protections in your jurisdiction require otherwise.
